Terms and Conditions for Bluebird Day Vacation Rentals  in Bend, Oregon

We are delighted to have you as our guests! Please take a moment to read the following Terms and Conditions agreement.  In booking a home with Bluebird Day you agree to the following.

QUIET HOURS: BEND NOISE ORDINANCE
Neighborhood noise disturbances put us at risk of losing our license. You are more than welcome to have fun dinners, gatherings, friends over, etc. but in accordance with Bend’s Good Neighbor Guidelines and the Bend Noise Ordinance, all outside activities MUST wind down by 10 pm. If a noise complaint is called in by a neighbor after 10 pm, you will be notified by our offices immediately, and a fine of $250 will be assessed. If a report is made that a party or loud group activity after 10 pm is occurring on the property, the Bend Police Department will be notified, you will be asked to vacate the property forfeiting any rental payments.

OCCUPANCY
If you exceed the maximum occupancy, you will be asked to vacate the property forfeiting any rental payments. You are welcome to host day time and evening visitors, but additional guests are not permitted to stay the night. Please notify our offices of any visitors you will be hosting. You must be 25 years or older to book a reservation. Homes may not be sublet.

PAYMENTS
The reservation fee must be paid in full 60 days before your arrival date, and will be automatically charged to your credit card unless you notify us before hand of a check payment. Payment is accepted by Master Card, Visa, and Discover. You may also pay by personal check or electronic check. (US Banks only, please) For electronic checks please enter the bank routing number, the checking account number, and the check number. To pay with a personal check, please mail to BDVR PO Box 1734, Bend OR 97709. A $50 fee will be charged for all returned checks. Please be sure to notify our office if you would like to pay for your reservation by check.

THIRD PARTY PAYMENTS & POLICIES
All reservations booked through a third party booking site such as Airbnb and VRBO are subject to their payment terms and policies. FOR AIRBNB RESERVATIONS All payment inquiries including cancellations must be directed to Airbnb guest services.

RATE CHANGES - Rates subject to change without notice. Rate at the time of booking is your set rate.

CANCELLATIONS
100% refund if your reservation is canceled at least 60 days before arrival date. 
50% refund if your reservation is canceled between 60 and 30 days before arrival date.

A 60 day notice is required to receive a full refund for cancellations. Cancellations made 30 days before your arrival will receive a 50% refund. ALL cancellations result in a $100 cancellation fee. For cancellations made less than 30 days before the arrival date, the following will apply: Bluebird Day will make all efforts to re-book the home for your allotted dates. Rental rates for dates that remain unbooked will not be refunded. A $100 cancellation fee will also be withheld. Refunds will not be given for early departures or changes to reservations made within 60 days of arrival.

ACCIDENTAL DAMAGE PROTECTION WAIVER VS WILLFUL DAMAGE
Each reservation includes a non-refundable Accidental Damage Protection Waiver. This waiver provides protection to the Guest for the cost of ACCIDENTAL damage to the property and its contents beyond normal wear and tear not to exceed the amount of $3000. Accidental damage MUST BE REPORTED to Bluebird Day before guest departure to qualify for protection.The Guest is responsible for any intentional damage, loss, or breakage within the home or on the property. The cost to replace or repair damage due to willful actions, misconduct, gross negligence, misuse, or pet damage will be charged to your credit card on file. Excessive cleaning will be charged to your credit card on file at a rate of $35/hr. A fee of $75 will be charged to drain and clean a hot tub. The waiver does not cover any additional management fees or noise violation fines.

You have the option of submitting a $1000 fully refundable security deposit in lieu of the Accidental Damage Protection Waiver fee. The waiver fee charged to your reservation will be applied to the security deposit total, and you will be refunded the full amount if all is left in accordance with this Terms and Conditions agreement. Please contact the Bluebird Day office if you would like to choose this option.

An active credit card is required to book your reservation. You are responsible for updating any changes to expiring credit cards.

Absolutely NO SMOKING (ANYTHING) IN THE HOME OR ON THE PROPERTY
Evidence of smoking will result in the appropriate charges to pay for sanitizing, de-odorizing, and cleaning the effected areas.

HOT TUB USAGE
Hot tub hours are from 8 am - 10 pm and are strictly enforced. Report of a noise disturbance in the hot tub after hours will result in a $250 fine. You are required to take a shower before hot tub use, and to adhere to the Hot Tub Rules posted near the hot tub. Additional fees will be charged for excess cleaning or draining of the hot tub. Bluebird Day assumes no liability for injuries or accidents incurred by your use of the hot tub. Bluebird Day Vacation Rentals, the Bluebird Day Staff, and the Home Owners are in no way responsible for bodily harm or injuries that may occur in or near the Hot Tub. The Guest agrees to use of the Hot Tub at your own risk. If you are staying in a home that has a hot tub, please read and sign the attached Hot Tub usage release waiver.

PARKING
Please park only in the designated parking spot, or directly in front of your home. Be conscientious of other’s privacy when asking your neighbors for directions or recommendations.

CHECK IN AND CHECK OUT
Check-in is 3:00 pm. Check-out is at 11:00 am.
We take pride in having our homes thoroughly cleaned between visits. No early check-in’s please without prior consent. Late check-outs of more than 15 minutes (unless previously arranged) will incur a rate of $25 per hour billed to your credit card on file.

PETS
If you are bringing along a furry dog friend, you must agree to the following guidelines: 

DOGS ONLY
Maximum 2 dogs per property
Your dog must be older than 1 year and weigh less than 100 lbs.
• Pets must be kept off of the furniture and the beds.
• Pets must not be left alone in the home unless in a crate or porter.
• The Guest is responsible for cleaning up all pet refuse. In the event that our housekeeping staff does this after you leave, you will be billed at a rate of $50 per hour with a one hour minimum. 

BIKES
Your vacation home is provided with bikes for you to enjoy. Helmets and locks are provided. YOUR WELL BEING IS YOUR RESPONSIBILITY. You are required to wear the helmets and lock the bikes up when you are out. You the Guest, agrees to release Bluebird Day Vacation Rentals and the home owners from any liability of injuries or theft while using the bikes. Stolen bikes that were not appropriately locked are your responsibility to replace.

HOME SUPPLIES AND HOUSEKEEPING
Your vacation home is supplied with fresh, clean linens, towels, toilet paper, paper towel, tissues, hand soap, body wash, hair dryers, and environmentally friendly cleaning supplies. There are washers and dryers in each home for your use, an iron and ironing board, and fully equipped kitchens including spices and plenty of dinnerware, flatware, cookware, etc. All Bluebird Day homes are equipped with barbecue grills (propane or charcoal provided) and free high-speed wireless internet.

Help us to “stay green” by using the provided recycling bins. There is one for “co-mingled” items such as paper, paperboard (cereal boxes, etc.) cardboard, aluminum, tin cans, and plastic. There is a separate container for all glass. Please rinse out your containers. Bluebird Day offers full service garbage removal. We will come and put out the trashcans on the appropriate day. Full housekeeping service is available during your stay for an additional fee. Please inquire before your arrival to ensure availability of our cleaning staff.

CHECK OUT PROCEDURE
Please place all dirty dishes in the dishwasher and start a load of dishes. Please start a load of towels in the washing machine.
Turn the thermostat to 55 degrees in the winter, and 75 degrees in the summer. Check that all doors and windows are locked and return the keys to the lockbox.

LOST AND FOUND
Bluebird Day Vacation Rentals nor the home owners are responsible for any personal items left in the home or on the property, including items lost or stolen.
Unclaimed items will be held for you for 30 days. After 30 days, all left items are donated to the Bend Humane Society Thrift Shop. We will be happy to ship retrieved items to you for a fee of $25 + the cost of postage. You may also send us prepaid packaging materials to retrieve the item.

RELEASE OF LIABILITY
Bluebird Day Vacation Rentals, the Bluebird Day Staff, and the Home Owners are in no way responsible for bodily harm or injuries that may occur while you are in the home or on the property, in the hot tub, or on the bicycles.

Violation of any federal, state or county laws as well as policies stated in this agreement are grounds for immediate eviction without refund. 

When you send an email to Bluebird Day Vacation Rentals or visit the web site, you are communicating with us electronically. You are consenting to receive communication from us in return, electronically. You agree that all agreements, notices, disclosure, and other communications that Bluebird Day Vacation Rentals provides to you electronically satisfy any legal requirement that such communication be in writing.
