Terms and Conditions

Thank you for choosing to stay with Bluebird Day.  By reserving one of the properties Bluebird Day Vacation Rentals (“Bluebird Day”) manages you have been granted a license to occupy the property identified in your reservation agreement (the “Property”).  We hope you and all those in your party enjoy your time with us at the Property.  To that end, please abide by the following Terms and Conditions throughout your stay.  Bluebird Day reserves the right to charge additional fees and to terminate any reservation or stay for failing to abide by these Terms and Conditions.  No refunds will be given for an early termination of your stay for failing to abide by our terms and Conditions.  These Terms and Conditions are in addition to and supplement the terms of your reservation agreement.

Our 24-hour contact information is: (541) 728-4400.  When you send an email to Bluebird Day or visit our web site, you are communicating with us electronically.  You are consenting to receive communication from us in return, electronically.

GOOD NEIGHBOR GUIDELINES, NOISE AND GUEST CONDUCT
The City of Bend has adopted Short Term Rental Operating License Good Neighbor Guidelines.  A copy of those guidelines is attached and may also be viewed at: https://www.bendoregon.gov/home/showpublisheddocument/48342/637434754495730000.  Bluebird Day expects all guests and visitors to honor these guidelines during their stay.
Please respect our neighbors quiet enjoyment of their homes by keeping music and other noises to an appropriate level.  There is a City of Bend noise ordinance which establishes specific daytime (7:00 a.m. to 10:00 p.m.) and nighttime (10:00 p.m. to 7:00 a.m.) noise limits.  The City’s noise ordinance may be viewed at: https://www.bendoregon.gov/Home/ShowDocument?id=9041. A part of the license to occupy the Property includes your commitment to act in a proper manner and refrain from doing anything that is likely to annoy or disturb other guests or adjacent property residents.  If guests: (i) are intoxicated, disorderly or otherwise act in a manner that creates a risk of harm to themselves or others; (ii) create a civil disturbance (such as excessive noise, large parties, threats or intimidation of employees, other guests or neighbors, etc.); (iii) permit occupancy greater than specified in the reservation; (iv) intentionally damage the Property; or (v) otherwise violate the law; the license will be terminated and the guest will be removed from the Property (by law enforcement if necessary). Failure to abide by the guidelines and our noise policies may result in the early termination of your stay and a $250.00 fee (and the out-of-pocket cost of repairing damaged property) which maybe be charged to the credit card on file regardless of the person who violates the guidelines.

WAIVER AND INDEMINTY
Upon check-in, guests accept the Property in its “as-is” condition and waive and release all claims against Bluebird Day and the Property owner for injuries, expenses, and losses of all kinds arising out of their occupancy of the Property.  Guests agree to defend, indemnify, and hold Bluebird Day and the Property owner harmless from and against all claims, losses and demands, including reasonable attorney fees, arising out of or relating to the occupancy of the Property except and then only to the extent such claims, loses, or demands are caused by Bluebird Day’s or the Property owner’s, sole negligence or intentional acts or omissions.

OCCUPANCY AND PARTIES
The number of people on the Property overnight shall not exceed the number of guests identified in your reservation.  Visitors are welcome, but they may not spend the night anywhere on the property.
Large (more than ten people) gatherings and parties are not allowed on the Property without prior written consent from Bluebird Day.  Failure to abide by these guidelines may result in the early termination of your stay and a $250.00 fee which maybe be charged to the credit card on file.

MINIMUM AGE FOR RESERVATIONS
Reservations may only be booked by individuals who are 25 years of age or older.

HEALTH AND SAFTEY
All guests must follow all local, state, and federal health and safety laws, rules, regulations, and guidelines while on the Property including, but not limited to rules and guidelines related to COVID 19 and any similar public health event.

PAYMENTS
All reservation fees and deposits are payable in full at the time the reservation is made.  Payment may be made by Master Card, Visa, and Discover credit cards.

THIRD PARTY BOOKING SERVICES
Bluebird Day accepts reservations through third-party services such as Airbnb and VRBO.  If you make your reservation through a third-party service, you agree to abide by the service’s rules and policies in addition to your reservation agreement and our Terms and Conditions.  All questions or concerns regarding a booking through a third-party service should be directed to that service.  Bluebird Day is not responsible for any promises, warranties, or representation made by any third-party service.

RATE CHANGES
The nightly rate, cleaning fees, deposits, taxes, and other charges for your stay are established at the time of your reservation.  All rates and fees for subsequent stays are subject to change without notice.

CANCELLATIONS
Fees for a reservation that is cancelled or shortened more than 60 days before check-in will be refunded.  Half of the fees for a reservation that is cancelled or shortened between 60 and 30 days before check-in will be refunded.  There are no refunds for changes to reservations less than 30 days before check-in including, cancellations due to inclement weather, poor driving conditions, smoke, or other events reasonably beyond Bluebird Day’s control.

ACCIDENTAL DAMAGE PROTECTION WAIVER VS WILLFUL DAMAGE
Each reservation includes a non-refundable Accidental Damage Protection Waiver. This waiver provides protection to the Guest for the cost of ACCIDENTAL damage to the property and its contents beyond normal wear and tear not to exceed the amount of $3000. Accidental damage MUST BE REPORTED to Bluebird Day before guest departure to qualify for protection. The Guest is responsible for any intentional damage, loss, or breakage within the home or on the property. The cost to replace or repair damage due to willful actions, misconduct, gross negligence, misuse, or pet damage will be charged to your credit card on file. Excessive cleaning will be charged to your credit card on file at a rate of $35/hr. A fee of $75 will be charged to drain and clean a hot tub. The waiver does not cover any additional management fees or noise violation fines.You have the option of submitting a $500 fully refundable security deposit in lieu of the Accidental Damage Protection Waiver fee. The waiver fee charged to your reservation will be applied to the security deposit total, and you will be refunded the full amount if all is left in accordance with this Terms and Conditions agreement. Please contact the Bluebird Day office if you would like to choose this option. An active credit card is required to book your reservation. You are responsible for updating any changes to expiring credit cards.

SMOKING/VAPING
All Bluebird Day properties are nonsmoking areas.  All forms of smoking (of any substance), including, e-cigarettes and vaping products are prohibited anywhere on the property; inside or outside.  Any violation of our nonsmoking policies may result in a charge of $250.00 together with the costs we incur to clean, de-odorize, or repair the property which maybe be charged to the credit card on file regardless of the person who violates the policy.

PARKING
Vehicle parking is at the vehicle owner’s sole risk.  Please park vehicles only in the garage and designated parking areas; do not block driveways or mailboxes or park in designated “no-parking” zones.  Personal items should not be left in unattended vehicles.  Bluebird Day and the Property owner are not responsible for vehicle damage or theft.
Some of our properties are located in areas that require City of Bend issued passes for on-street parking.  Bluebird Day provides laminated parking passes for these properties.  Guests must display the parking pass on their vehicle dash when parking on the street and may be cited for failing to so.  Bluebird Day is not responsible for guest parking citations.

CHECK IN AND CHECK OUT
Check-in begins at 4:00 p.m. and check-out is at 11:000 a.m.  To accommodate our staff and other guests we do not allow early check-in or check-out without our prior approval.  Bluebird Day reserves the right to charge the credit card on file for an additional night if you overstay your scheduled check-out time. Please load all dirty dishes and start the dishwasher and all used towels and start the washing machine before you leave.  Lock all doors and windows and return all keys and garage door openers to their original location.  All garbage must be properly disposed of in the provided outside trash/recycling containers.

PETS
Pet-friendly properties are identified on our website; https://www.bluebirddayvacationrentals.com.  If the Property is not listed as a pet-friendly property, no pets are allowed without exception.  Dogs are the only pets allowed on any Bluebird Day property without prior written consent which may be withheld at Bluebird Day’s sole discretion. If the Property is identified as pet-friendly, then you may bring no more than two (2) dogs and the dog(s) mut be at least one (1) year old and less than 100 lbs.  Guests are responsible for cleaning up after their dog(s) and properly disposing of all waste.  Dogs shall not be left unattended on the Property.  Failure to abide by our pet policy may result in the early termination of your stay and a $250.00 fee together with any additional cleaning, de-odorizing, and damage repair costs which maybe be charged to the credit card on file.

HOT TUBS AND BARBEQUES
Many of our properties have hot tubs and outdoor barbeque grills.  Guests are expected to familiarize themselves with the operating procedures and safety rules before using these amenities.  Guests using these amenities do so at their own risk and expressly waive all claims for personal injury or loss of any kind arising out guest use of hot tubs and barbeques on the Property.
Hot tubs rules are posted near all hot tubs.  Hot tub hours are from 8:00 a.m. to 10:00 p.m. and are strictly enforced.  Children under five (5) years old are not allowed to use hot tubs and all children under 16 years old must be supervised by an adult while using a hot tub.  Please shower before using the hot tub.  Bluebird Day reserves the right to charge the credit card on file for all costs incurred because of the misuse of hot tubs. Barbeques may only be used by adults.  Propane must be turned off at the valve (if applicable) immediately after barbeque use.  Guests are responsible for cleaning barbeques after each use.

BICYCLES
Some of our properties include complimentary use of bicycles.  Helmets and locks are provided for your convenience, however, neither the Property owner nor Bluebird Day are responsible for helmet fitment or bicycle safety.  Guests using complimentary bicycles do so at their own risk and agree to hold Bluebird Day and the Property owner harmless and indemnify each of them any expense, loss, or injury associated with bicycle use.  Guests are responsible for lost, damaged, or stolen bicycles.  Bluebird Day reserves the right to charge the credit card on file with the cost of replacing or repairing lost, damaged, or stolen bicycles and helmets.

HOME SUPPLIES AND HOUSEKEEPING
Each property is supplied with fresh linens, towels, toilet paper, paper towels, tissues, hand soap, body wash, hair dryers, and environmentally friendly cleaning supplies as well as washers and dryers, an iron and ironing board, and fully equipped kitchens, including spices and dinnerware, flatware, cookware, etc.  These items are provided for guest use on the Property only; please do not remove them from the Property.  Please report any lost or damaged items before check-out.
Bluebird Day does not provide daily housekeeping services.  Mid-stay housekeeping may be arranged for in advance of your stay and is subject to additional fees.  Bluebird Day provides garbage removal services and will take all trash/recycling containers to the curb on the appropriate day. Please use the provided recycling bins.  There is one for “co- mingled” items such as paper, paperboard (cereal boxes, etc.) cardboard, aluminum, tin cans, and plastic.  There is a separate container for all glass.  Please rinse out your containers.

CONSTRUCTION
Bend, Oregon is one of the fastest growing communities in our state.  During your stay, Bluebird Day Vacation Rentals is not responsible for construction in the surrounding neighborhoods or streets.  Bluebird Day Vacation Rentals does not have control over any other location that is not Bluebird Day property.  However, if there is an issue on site, please call Bluebird Day immediately at 541-728-4400.

LOST AND FOUND
Bluebird Day and the Property owner are not responsible for lost, stolen, or forgotten personal items.  If you forget personal items and would like them shipped back to you, there is a minimum charge of $25.00 plus the cost of shipping and insurance (if any).  There may be additional charges for multiple, large, or heavy items.  Bluebird Day is not responsible for any personal property left behind or damaged in shipping.  Unclaimed items will be held for 30 days.  After 30 days, all left items are donated to the Bend Humane Society Thrift Shop.
